KUALA LUMPUR: The mother of A. Kugan, the detainee who died while in custody at the Taipan police lockup in Subang Jaya, today filed a RM100 million suit against Deputy Inspector-General of Police Datuk Seri Khalid Abu Bakar and four others for negligence and breach of statutory duty.
The administrator of the estate, N. Indra, also named Police Constable V.Navindran, former Subang Jaya District Police Chief ACP Zainal Rashid Abu Bakar, the Inspector-General of Police and the government as defendants.
She filed the suit through the legal firm of Edwin Lim Suren & Soh at the High Court registry about 9am.
In the statement of claims, Indra claimed that all the defendants had failed to ensure the safety, health and welfare of the deceased (Kugan) when he was in police detention from Jan 14 to 20, 2009 and also to supervise and monitor the policemen there.
The 44-year-old woman also claimed that the defendants had failed to provide a safe system in the questioning of the suspect while in police detention and also failed to provide health care for her son.
Indra claimed that the defendants also attempted to cover-up the actual cause of Kugan’s death and/or issued statements calculated to exonerate the police from blame or liability.
She is seeking damages of RM100 million , as well as exemplary damaged, cost and other relief which the court deems fit.
On Jan 28 last year, the Petaling Jaya Sessions Court acquitted and discharged Navindran on two counts of causing grievous hurt on Kugan.
