KOTA KINABALU: A middle eastern man embroiled in an assault case that was uploaded on YouTube, will be charged under Section 323 of the Penal Code for voluntarily causing hurt.
City police chief Assistant Commissioner Ahmad Sofi Zakaria said the Egyptian, in his 40s, will be brought to court once the subpoena is issued.
He faces a maximum one-year jail term or RM2,000 fine, or both.
The assault allegedly took place on Feb 9 around 6.30pm when the suspect attacked a receptionist of a backpackers lodge and two other tourists.
The incident was posted in YouTube showing parts of the Egyptian slapping a 22-year-old receptionist of the lodge.
It also shows the assailant moving to hit a Canadian girlfriend.
The 30-year-old Canadian man had claimed that the assailant, who was also staying at the lodge, became irate when he kissed his girlfriend from Peninsular Malaysia on the cheek at the lounge area of the lodge.
The assailant then fled the lodge prompting police to monitor all exit points in the State including the airport.
